Welcome to Komi Counseling and Psychology (“Company,” “Practice,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at [https://komicounseling.com](https://komicounseling.com) (the “Website”), along with any related contact forms, scheduling tools, and educational content (collectively, the “Services”).
By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Website. We reserve the right to modify these Terms at any time, indicated by the revised “Effective Date” above.
3. No Clinical Relationship Created via Website
The information provided on this Website (including articles, clinician profiles, FAQ content, and contact forms) is for general educational and informational purposes only. Browsing this Website, sending a message through our contact form, or requesting an initial consultation DOES NOT establish a therapist-client or doctor-patient relationship with Komi Counseling and Psychology or any of its clinicians.
A formal professional clinical relationship is established ONLY after you have completed our formal intake process through PracticeQ, signed our Informed Consent for Treatment, and received explicit confirmation from a licensed clinician.
4. Professional Licensure & Jurisdictional Scope
Our practice provides hybrid mental health services (in-person sessions in Provo, Utah, and telehealth sessions).
In-Person Services: Provided exclusively at our office in Provo, Utah County, Utah.
Telehealth Services: Telehealth services are provided to clients physically located in the State of Utah and in states participating in the Psychology Interjurisdictional Compact (PSYPACT), provided the treating clinician holds active authorization under PSYPACT.
By requesting or receiving telehealth services, you represent and warrant that you are physically present in Utah or an authorized PSYPACT jurisdiction at the time of your session. We do not offer therapy services in jurisdictions where our clinicians are not legally authorized to practice.
5. Services Provided & Minors Policy
Komi Counseling and Psychology offers mental health counseling and psychological services for adults and minors.
Adult Services: You must be at least 18 years of age (or the age of majority in your jurisdiction) to independently request services via the Website.
Services for Minors: Minor clients (under 18 years of age) may receive counseling services only with the express written consent and authorization of a parent or legal guardian, completed through our PracticeQ intake portal.
6. Client Portal & Third-Party Platforms (PracticeQ)
Certain features of our Services—including online appointment scheduling, clinical intake forms, telehealth sessions, secure messaging, and billing—are hosted through PracticeQ (our secure Electronic Health Record system). When accessing PracticeQ or other third-party patient tools, you may be subject to additional terms of service provided by those platforms. You agree to keep your login credentials confidential and notify us immediately of any unauthorized access.
7. Acceptable Use
You agree not to use the Website to:
Transmit emergency or crisis communications.
Submit false, misleading, or fraudulent information.
Transmit unencrypted sensitive medical or personal health information via standard public web forms.
Attempt to gain unauthorized access to our Website, server, or PracticeQ client portal.
Use automated scrapers, bots, or crawlers to harvest data from our Website.
Engage in any behavior that violates local, state (Utah), federal, or interjurisdictional laws.

IN NO EVENT SHALL KOMI COUNSELING AND PSYCHOLOGY, ITS CLINICIANS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THIS WEBSITE OR RELIANCE ON ANY INFORMATIONAL CONTENT HEREIN. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED $100 USD.
10. Governing Law and Mandatory Binding Arbitration

Waiver of Jury Trial: You and Komi Counseling and Psychology explicitly waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury.
Class Action Waiver: ALL CLAIMS AND DISPUTES MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST KOMI COUNSELING AND PSYCHOLOGY ONLY IN YOUR INDIVIDUAL CAPACITY.
